FORT PIERCE -- A 77-year-old man charged with grabbing a 12-year-old girl at a Hutchinson Island Beach in August 2005 was found guilty Friday of attempted lewd molestation and attempted false imprisonment.

A 19th Circuit court jury deliberated about six hours Thursday afternoon and Friday morning at the St. Lucie County Courthouse before reaching the verdict.

Dalton Earl Whaley of Port St. Lucie was 74 at the time he allegedly grabbed the girl in a "headlock" and tried to drag her to a parking lot where his vehicle was parked near Dollman Beach in southern St. Lucie County, according to arrest reports. When a witness yelled at Whaley, he let the girl go and drove off, according to the report.

Whaley testified that the incident was a misunderstanding, that he accidentally bumped into the girl.

Whaley originally was charged with lewd or lascivious molestation, a second-degree felony, and attempted aggravated kidnapping, a first-degree felony. The charges he was convicted of are both third-degree felonies.
