Former sheriff Clarence Shepard gets probation for molesting girl

News-Press.com, Fort Meyers, FL

April 30, 2009

A former Indiana sheriff pleaded guilty Tuesday to one count of lewd and lascivious conduct and he will serve 10 years on sexual offender probation and two years on house arrest.

Clarence Shepard, 77, was arrested in October after an 11-year-old girl, a daughter of a family friend, told her mother Shepard touched her inappropriately and said he asked her to touch him.

In court Tuesday, Shepard accepted the state's plea deal rather than face a trial on a charge of lewd and lascivious molestation, a first-degree felony punishable by up to life in prison. The lewd and lascivious conduct charge is a second-degree felony.

Shepard was a sheriff in Vanderburgh County, Indiana for eight years in the 1980s and 1990s and he has more than 20 years in law enforcement. He later served as president of an association that represents all Indiana sheriffs before he retired to North Fort Myers in the early 1990s.

State attorney's office spokeswoman Samantha Syoen said Shepard will have to wear a GPS ankle bracelet throughout his entire term of probation. Sex offender probation requires defendants to avoid areas where children congregate, to take part in a sex offender treatment program and other requirements.

Tennis teacher Henry Germain to get prison time in molest case

Henry Germain

By Henry K. Lee, San Francisco Chronicle Staff Writer

April 29, 2009

Pleasanton, CA - The head tennis instructor at a Pleasanton country club pleaded no contest Tuesday to three counts of child molestation and will be sentenced to 15 years in state prison, his attorney said.

Henry Germain, 62, of Dublin entered his pleas before Judge Christine Moruza in a Pleasanton courtroom. In exchange for his pleas, prosecutors agreed to drop 13 other child-molestation counts, said his attorney, Elizabeth Grossman.

Germain will be sentenced May 22. He will be required to register as a sex offender. Germain was arrested at the Castlewood Country Club in September on suspicion of molesting three girls ages 9 to 12 from 1995 to 1999, authorities said. The girls were the children of club members.

The investigation began when two victims told club management about the alleged abuse and secretly recorded a conversation with the suspect in which he apologized to them, authorities said.

After Germain was arrested, other victims came forward, authorities said.

They alleged that they were abused within the last three or four years, Nelson said.

Ex-school resource officer Todd Pierce gets 10 years for sex with teen

By Curtis Krueger, St. Petersburg Times

April 28, 2009

LARGO - Former school resource officer Todd Pierce stood in the courtroom, turned to his victim and apologized to her, saying, "I am sorry for what you've had to go through. I can't begin to imagine what you've had to endure."

But he stopped short of admitting to the crimes he was convicted of - lewd and lascivious battery and lewd or lascivious molestation, including having sex with a 15-year-old girl.

Pinellas-Pasco Judge Timothy Peters sentenced Pierce to 10 years in prison and five years of sex offender probation.

Peters noted that Pierce, a former Pinellas sheriff's deputy and assistant high school football coach, appeared courteous, thoughtful, hard working and generally law abiding. But he added that "in our society, as well as most societies, you cannot lawfully have sex with children."

And Pierce's actions were even worse, because he held a position in school so important that "to say that person is a role model is a dramatic understatement." And he said the jury's actions were well justified by the evidence presented in court.

The sentencing for the 2001 crimes was an emotional one that featured statements of support from Pierce's sister, fellow coaches, two assistant principals at Countryside High School, his pastor and lifelong friends.

"My dad, he wouldn't be the type to disrespect anyone in that manner," said son Todd Pierce Jr., 16. He said the allegations against his father "just don't even match the character" that he has.

"I love you son," Pierce told him afterward.

"I love you too, Dad."

Pierce asked for leniency, saying he would do any kind of community service the judge ordered, without fail, and that he would not bother any children. "I can assure you that no one is in danger."

The fiance of the victim, whose name the St. Petersburg Times is withholding because of the nature of the allegations, told the court she accepted Pierce's apology.

The woman, now 23, had testified that Pierce fondled her in Osceola High in 2001 but that she told no one because "he knows how to manipulate you." Then, in September 2001, he came to her house when no one else was at home. Once inside, she said, he performed oral sex on her and they had intercourse.

Roylat "Wally" Johnson sentenced in molestation of three boys

By David Castellon, Visalia Times-Delta

April 22, 2009

A Visalia, Calif., man was sentenced to 10 years in prison Tuesday after pleading no contest to charges stemming from the molestation of three boys.

Tulare County Superior Court Judge Joseph Kalashian handed down the sentence against Roylat "Wally" Johnson, 37. He entered his plea March 23 to three counts of lewd and lascivious acts with a child younger than 15.

While not an actual admission of guilt, a no-contest plea is treated as a guilty plea by the court.

Two of the boys reported being molested by Johnson in 2001. They told Visalia police they were 8 and 9, respectively, when the incidents happened, an announcement by the Tulare County District Attorney's Office states.

The third boy, age 10 when molested, came forward last year.

All claimed to have been molested in the home of the man they knew as "Wally" while their mothers weren't there, prosecutors report.

The conviction is Johnson's third strike, which under California's "Three Strikes" law requires him to serve 85 percent of his prison sentence before becoming eligible for parole.

Johnson also was ordered to pay $3,000 in fines. Upon his release, he'll have to register as a sex offender.

Arrival of sex offender Raymond Fournier raises concern

By Daymond Steer, The Cabinet Press

April 16, 2009

MONT VERNON, N.H. - Two weeks after a man the state sought to commit as a "sexually violent predator" moved to town, school officials, police and some parents are doing what they can to raise awareness and enhance student safety.

Raymond Fournier, 40, was released from prison April 3 and is now living with relatives at 1 Salisbury Road. Fournier was convicted in 1994 of several counts of aggravated felonious sexual assault on victims under 13 years old.

The state had sought to have Fournier - who has served his full sentence - civilly committed as a sexually violent predator under a relatively new state law, but released him two weeks ago after a superior court judge found that the court did not act on a petition to have him committed in the time allowed under the law.

Fournier's release was discussed last week at the Mont Vernon School Board meeting. Fournier's new home is just less than four miles away from Mont Vernon Village School. Salisbury Road is a rural dirt road near the Lyndeborough town line.

Lyndeborough Central School's PTA also sent out a flier to parents about Fournier's release because he lives near the town line. The flier says many Lyndeborough families live within a mile of him.

In 1994, Fournier pleaded guilty to seven counts of aggravated felonious sexual assault. He was sentenced to five to 15 years in prison and due to be released on June 16, 2008, according to Supreme Court documents.

Robert Beaudet Talbot remains jailed on charges of child molestation

By TaMaryn Waters, Tallahassee Democrat

April 8, 2009

A 61-year-old man remains in the Wakulla County Jail after being arrested April 1 on charges of lewd and lascivious molestation of a child under the age of 12.

And based on current leads, the investigation could cast a wider net that reaches into Leon County.

Robert Beaudet Talbot, a resident of the Ochlockonee Bay area, was arrested at his home, said Lt. Jason Newlin of Wakulla County Sheriff's Office. A 6-year-old girl and a 12-year-old boy were identified as victims.

Talbot is an officer with Talbot Home Builders Inc, a Tallahassee construction company, according to the Florida Department of Business of Professional Regulation.

The charges are based on multiple incidents that occurred between November and March, according to the incident report. Newlin said evidence such as pornographic photographs and VHS videos were confiscated from Talbot's home. Newlin said Talbot had access to the children through an acquaintance.

According to the report, the children would be at Talbot's home two to three times a week for up to four hours at a time. He'd invite the children over to his home for brownies and cake.

Newlin said a "multi-jurisdiction investigation" may also include a collaboration with the Leon County Sheriff's Office since Wakulla investigators think there could be more victims.

"At this time, we are trying to identify other victims," Newlin said.

Talbot is being held without bail.
